Terms of Service

These Terms of Service ("Terms") govern your use of the BirdOdex mobile application ("App") operated by Futuron Inc ("we," "our," or "us"). By using BirdOdex, you agree to these Terms.

1. Use of the App

BirdOdex is a bird identification and collection app. You may use the App for personal, non-commercial purposes. You agree not to:

Reverse engineer, decompile, or disassemble the App
Use the App for any unlawful purpose
Attempt to gain unauthorized access to our services
Use automated systems to access the App in a manner that exceeds reasonable use

2. AI Bird Identification

Our AI-powered bird identification provides its best estimate based on the photo you submit. Identifications are not guaranteed to be 100% accurate. Do not rely on BirdOdex for safety decisions (e.g., identifying potentially dangerous wildlife). The AI is for educational and entertainment purposes.

3. Subscriptions & Purchases

Free Tier: BirdOdex offers limited free bird identifications per day.

BirdOdex Pro: Premium features are available through auto-renewable subscriptions or a one-time lifetime purchase:

Weekly: $9.99/week
Yearly: $49.99/year
Lifetime: $99.99 one-time purchase

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account. You can manage and cancel subscriptions in your device Settings → Apple ID → Subscriptions.

4. Refunds

All purchases are processed through Apple. For refund requests, please contact Apple Support.

5. Intellectual Property

The App, including its design, code, content, and the BirdOdex brand, is owned by Futuron Inc. Bird photos you take remain yours. By using the identification feature, you grant us a temporary, limited license to process your photo for identification purposes only.

6. User Content

Photos and sighting data you create within the App are stored locally on your device. You retain full ownership of your content.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the App will be error-free, uninterrupted, or that bird identifications will be accurate.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUTURON INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP.

9. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, United States.
